OVERVIEW This website is operated by Hydra. Throughout the site, the terms “we”, “us” and “our” refer to Hydra. Hydra offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein.
SECTION 1 - GENERAL CONDITIONS We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.
SECTION 2 - PRODUCT INFORMATION AND MEDICAL DISCLAIMER The Hydra floating water bowl is designed to minimize water spillage and assist in keeping your pet’s feeding area clean. While our marketing materials may mention cosmetic or hygienic benefits (such as preventing wet facial hair or minimizing the risk of moisture-related skin conditions), our products are not medical devices. We do not provide veterinary advice. You agree that the use of our product is not a substitute for professional veterinary care, and we make no claims that our product cures, treats, or prevents any animal diseases or medical conditions. Always consult your veterinarian regarding your pet's health.
SECTION 3 - PRODUCT USE AND SUPERVISION The Hydra bowl contains detachable components (including the top edge strip and the floating plate) designed for easy cleaning. It is the pet owner’s absolute responsibility to ensure the product is fully and correctly assembled before each use. Supervision is required. You agree to supervise your pet while they are using the product, especially during the initial adaptation period. Hydra shall not be held responsible if a pet intentionally damages, chews, or breaks the product, nor for any resulting harm, including but not limited to choking hazards, ingestion of parts, or physical injury.
SECTION 4 - ACCURACY OF BILLING AND ACCOUNT INFORMATION We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address provided at the time the order was made.
SECTION 5 - LIMITATION OF LIABILITY In no case shall Hydra, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, replacement costs, property damage (including water damage to floors or furniture), or any bodily injury to humans or pets arising from your use of any of our products. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law, and shall in no event exceed the total amount you paid for the product.
SECTION 6 - INDEMNIFICATION You agree to indemnify, defend and hold harmless Hydra and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
SECTION 7 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Israel.
SECTION 8 - SEVERABILITY In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable under the applicable laws of your jurisdiction (including mandatory EU consumer protection laws), such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 9 - DISPUTE RESOLUTION AND CLASS ACTION WAIVER (US & GLOBAL) By agreeing to these Terms, you agree that any dispute, claim, or controversy arising out of or relating to your purchase, the product, or these Terms shall be resolved strictly on an individual basis. YOU AND HYDRA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. No court or arbitrator may consolidate more than one person's claims, nor otherwise preside over any form of a representative or class proceeding.
SECTION 10 - CHANGES TO TERMS OF SERVICE You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
